Respect for intellectual property
Ademy respects the intellectual property rights of others and expects teachers and members to do the same. Teachers may only publish content they own or are licensed to use. We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA), the EU Digital Services Act (DSA) and other applicable laws.
Designated agent
Notices and counter-notices should be sent to our designated agent:
Copyright Agent, Ademy Group
Email: [email protected] (subject: "DMCA notice")
How to report infringement
If you believe content on Ademy infringes your copyright, send a written notice to our designated agent that includes:
- Your physical or electronic signature (or that of the person authorized to act on behalf of the copyright owner).
- Identification of the copyrighted work you claim has been infringed (or a representative list if there are several).
- Identification of the material you claim is infringing and that you want removed, including the URL(s) on Ademy where it appears.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
Please note that under the DMCA anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. If you are not sure whether material infringes your rights, consider getting legal advice first.
What happens next
We review every valid notice promptly. When appropriate, we remove or disable access to the material and notify the teacher or member who uploaded it, including a copy of the notice (with your contact details if needed for a counter-notice).
Counter-notice
If your content was removed and you believe it was removed by mistake or misidentification, you can send a counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and the location (URL) where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the courts of the place where your address is located (or, if your address is outside the European Union, the courts of Spain), and that you will accept service of process from the person who sent the original notice or their agent.
We will forward the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we may restore the material within 10 to 14 business days after receiving the counter-notice.
Repeat infringers
We keep a record of valid notices. In appropriate circumstances, we suspend or terminate the accounts of members and teachers who repeatedly infringe the rights of others.
Reporting illegal content in the EU (Digital Services Act)
If you are in the EU, you can also report content on Ademy that you believe is illegal (including, but not limited to, copyright infringement) by emailing [email protected] with the subject "DSA notice". Please explain why you consider the content illegal, give its exact URL, your name and email address (unless the report concerns child sexual abuse material), and confirm that your report is accurate and made in good faith. We will confirm receipt, review the report diligently and objectively, and tell you our decision and how you can challenge it. If we remove content, we will tell the person who posted it why and how they can contest the decision. This email address is also our single point of contact for authorities and users under the DSA.
